If you are convicted of a, low tier, first offense DUI in Ohio your attorney may be able to negotiate the jail time to be served in a 3 day driver’s intervention program in lieu of jail. This is typically from Thursday until Sunday night. The balance of any other jail time imposed by the court will have to be done all together. This is a secured facility. Meaning, you will be unable to leave the premesis during those 3 days.
You might be able to ask the court to schedule the exact day to begin your confinement, but that is up to the discretion of the court and the availability of the program. Typically a court will grant a stay of the days if we enter a plea, but if we lose at trial you can expect to start any jail time immediately.
